How the vote is counted

RDW, the Dutch vehicle authority, granted a provisional type-approval for FSD Supervised on 10 April 2026 under Article 39 of Regulation (EU) 2018/858. Other member states may recognise that approval on their own roads. These nine have. The driver stays responsible. This is not an unsupervised system.

An EU-wide authorisation is a separate decision. The Commission asks the Technical Committee on Motor Vehicles. The committee votes by qualified majority: at least 15 of the 27 member states, representing at least 65% of the Union’s population. That is Article 16(4) of the Treaty on European Union, applied through the examination procedure in Regulation (EU) No 182/2011.

Population is not a live headcount. For the whole of 2026 the weights are the figures in Annex III of the Council’s Rules of Procedure. The 27 figures sum to 452,162,974. Sixty-five percent of that total is 293,905,933.

National approval is not a ballot already cast in the committee. The percentage is the weight these countries carry if they vote together. A blocking minority must include at least four member states. Fewer than four votes against, and a qualified majority is treated as reached even if the population share is short. Nine states at 13.87% do not get there either way.
